1. Scope of Agreement
These terms govern all mentoring services, workshops, calls, digital products, and community memberships (including The Lemonade Factory) provided by Cassie Wilkins. By accessing the site, making a payment, settling an invoice, attending a session, or purchasing a subscription/course, you confirm your acceptance of these terms. This agreement remains in effect for the duration of our professional engagement until terminated by either party in writing.
2. Nature of Service & Professional Boundaries
- Creative Scope: I provide creative mentoring and narrative exploration. I am not a licensed psychologist, medical doctor, or financial advisor. My services are developmental and educational, not clinical.
- No Guarantees: While I am dedicated to supporting your growth, I do not promise or guarantee specific life, career, or business-related outcomes, including increased profitability or business success.
- Self-Responsibility: You remain 100% responsible for your own physical, mental, and emotional well-being, and for any decisions or actions taken based on our sessions.
- Referrals: I reserve the right to pause sessions and recommend seeking further support if your needs fall outside my scope of practice. Paused sessions must be used within 6 months or risk being forfeited.
3. Financial Terms, Subscriptions & Refunds
- Investment: All prices are as stated. Unless otherwise noted, Cassie Wilkins is not currently registered for GST and no GST has been charged. Should registration occur, GST will be applied to all applicable taxable supplies from the date of registration as required by law.
- Payment Timing: For 1:1 sessions, payment must be received in full a minimum of 72 hours before the scheduled call. Failure to do so may result in the forfeiture of your timeslot.
- Subscriptions: Memberships are billed on a recurring basis. You are responsible for managing your subscription. Access may be suspended immediately if a payment fails. No partial refunds are issued for mid-cycle cancellations.
- Refunds: Per Australian Consumer Law, refunds are not provided for “change of mind.” Once a service or digital product has been purchased, the investment is non-refundable.
4. Scheduling & The 6-Month Rule
- The 24-Hour Rule: I require 24 hours’ notice to reschedule 1:1 sessions. Late cancellations or no-shows result in a forfeited session.
- Shelf Life: All 1:1 sessions must be utilised within 6 months of the initial invoice date. Unused sessions after this timeframe are forfeited without refund.
5. Confidentiality & Community Conduct
- Individual Privacy: 1:1 details are held in strict professional confidence, except where disclosure is required by law or in cases of immediate risk of harm to self or others.
- The “Vegas” Rule: In group spaces (The Lemonade Factory/Masterminds), you agree to keep the identities and stories of other participants strictly confidential.
- User Content: While you retain ownership of your own stories, by posting within my community spaces, you grant me a non-exclusive license to host and display that content so the community can remain functional.
6. Conduct & Termination
I reserve the right to terminate services or access to me or my community spaces immediately, indefinitely, and without refund, if your behaviour becomes:
- Abusive, harassing, or inappropriate toward me or any other members.
- A breach of professional boundaries or these Terms.
7. Intellectual Property (IP) & AI Integrity
- IP Protection: All materials and narrative tools are proprietary to Cassie Wilkins. They are for your personal use only.
- AI Protection: I will not use your work or voice to train Generative AI. You agree not to use my proprietary concepts or tools to train AI models.
8. Indemnity & Liability
- Indemnity: You agree to indemnify Cassie Wilkins against any claims, loss, or expenses arising from your breach of these Terms or your application of the services provided.
- Limitation of Liability: To the fullest extent permitted by law in WA, my total liability is limited to the amount paid for the specific service in question.
9. Force Majeure
Neither party shall be liable for any failure or delay in performance of this agreement which is caused by circumstances beyond their reasonable control, including but not limited to natural disasters, government restrictions, widespread technology failure, or sudden ill health/incapacity. In such events, I will endeavour to reschedule services within a reasonable timeframe.
10. Dispute Resolution
If a dispute arises, the parties agree to attempt to resolve the matter through good-faith negotiation. If the matter remains unresolved after 14 days, the parties agree to attend mediation in Perth, WA (or via mutually agreed digital mediation), before commencing any legal proceedings.
11. Governing Law & Jurisdiction
This agreement is governed by the laws of Western Australia. You irrevocably submit to the exclusive jurisdiction of the courts of WA..
